These Terms and Conditions govern the sale and provision of our personal matchmaking service and form the basis of the contract between us and you. By signing the membership agreement provided, you confirm that you have read, understood and accept these Terms and Conditions. Your fee paid is inclusive of any VAT and is noted along with the duration of your membership, on your membership agreement. Your contract with us commences on the date that we accept your payment and our service to you is subject to these terms and conditions.
Terms of Membership
Members are required to be unattached and no longer living at the same address as a former partner and must provide true and accurate information relating to their circumstances. All our clients are interviewed. All introductions that we will recommend to you will be other parties who have also been interviewed. We accept the particulars given to us by you and all our clients in good faith and we also advise you to verify those particulars for yourself. We do not accept any liability for the validity of information provided.
Membership Service
Throughout your membership period we will send you profiles of other members according to your stated preferences where possible. No guarantee is given that any introduction we recommended to you will satisfy all your partner preferences. We reserve the right and absolute discretion to suggest introductions to you who we consider might be acceptable to you, notwithstanding that the prospective partner concerned may only match your partner preferences to a degree. The number of introductions we are able to offer you is not guaranteed and will depend both on your personal characteristics and how narrow or otherwise your preferences are in the partner that you seek.
You must not discuss or show any details of other clients to other members or non-members at any time during or after your membership. We will hold your details in the strictest confidence and only pass on your contact details to another member with your permission to do so. You agree not to disclose any of your experience or the identity of anyone you have met through our introductions service to media outlets without the permission of us and of the member concerned. We abide by the Data Protection Act and will not, without your agreement, supply any information to any person or outside company for use in marketing or for any other purpose.
Suspending Membership
You are entitled to suspend your membership with us for a maximum period of 5 months by notifying us in writing. Periods of suspension may last from one month to 5 months and it is your responsibility to inform us when you would like to reactivate your membership. Any suspension(s) of membership beyond a total duration of 5 months will not be added on to your agreed membership period.
Terminating Membership
We have the right to terminate your membership in the following circumstances:
- Where you have breached the confidentiality of another member, having been found to have shown confidential personal profiles to any third party outside our organisation or within our membership.
- Where in our sole opinion, you have acted inappropriately or shown unacceptable discourtesy to either another member or to a member of our staff or any representative of our company.
- Where you have failed to maintain contact or respond to our contact for a period of time in excess of 5 months.
- Where you have provided false information to us.
- Where we have received a serious complaint about you which in the sole opinion of our Managing Director, is justified.
In the event of a termination of contract a refund of any of your fee will only be applicable if we have breached these terms and conditions or in accordance with your consumer rights or if we have failed to provide a service to you with reasonable care and skill. You will not be entitled to any refund due to any change in your circumstances beyond our control and this would include the formation of a lasting relationship at any time before the expiry of your membership with us.
This does not affect your right to cancel within 14 days. Should you have requested that we begin your service immediately and request cancellation within this 14 day period, your fee would be returned to you minus the following costs for any work already undertaken: profiling consultation, £100 plus travel costs, your profile drafted, £40, data entry and administration following your profile approval £20; initial searches conducted on your behalf and a first recommendation sent to you, £30; relationships coaching session £100 (if applicable) Should you wish to cancel within 14 days please contact us in writing by letter or email kate@littleblackbook.com.
General
We may assign this contract for operational reasons or in connection with a business transfer or reorganisation. Otherwise this contract is non-transferable. This contract is subject to English law and the English courts will have jurisdiction in respect of any dispute arising from this contract. If any provision shall be found by an English court to be unenforceable or invalid this shall not affect other provisions
